Speakeasy Telecom International Phonecards Terms & Conditions

These Terms & Conditions set out the terms under which Speakeasy Telecom Limited ("Speakeasy"), provides you with the ability to make calls using Speakeasy's physical pre-paid phone cards ("Speakeasy phonecard (s)") referred to throughout these terms as "Speakeasy Phonecard Services".

References to "we", "us" and "our" are to Speakeasy and we refer to you as "you" and "your". This includes Speakeasy Phonecard Services (on-line Top up service) referring to our products such as Call Me Baby, Love2Talk, Love2Talk GOLD, Speaksaver and Talk Direct.

Please read these Terms & Conditions carefully as they affect your rights and liabilities under the law and the terms governing your use of Speakeasy's Phonecard Services. By using Speakeasy Phonecard Services, you agree to these Terms & Conditions.

1. What are Speakeasy Phonecards?
  • 1.1 Speakeasy Phonecard Services are initially supplied with a pre-paid amount of certain monetary value and you can add Credits (as defined below) to Speakeasy phonecards by purchasing a Top Up to enable you to make national and international phone calls from landlines, mobile phones and payphones.
  • 1.2 Speakeasy Phonecard Services come in a variety of monetary values ("Credit(s)"). Please see the FAQs for the details of the top-up amounts we currently offer.
  • 1.3 Each time you make a call there are the following three parts to the process:
  • a. The Access Number: this is a UK geographical number, which you will need to dial when using the Speakeasy phonecards. We do not charge you for this part of the call, but your phone provider may, as they would if you were making a call to UK landline. These calls are commonly included in your inclusive minute bundles.
  • b. The "Connection Charge": this does not apply automatically to all Speakeasy phonecards, except on some products and is limited to a few destinations to cover the costs of our UK switching equipment.
  • c. The "Call Rates": these are minute plus minute rates charged for calling the specified country and will vary depending on whether you are calling a mobile or landline. Please visit the Rates & Coverage page for Call Rates as published and updated from time to time. In the event of a conflict between any Call Rates set out on speakeasytelecom.com and any call rates set out on any other media, the Call Rates set out on speakeasytelecom.com shall take precedence.
2. Validity Period:
  • 2.1 Speakeasy Phonecard Services are valid for 120 to 365 days. The Valid from period starts from 'First Use' up to the 120 or 365 days as shown on the Phonecard. After the Validity Period, you will still be able to use your Speakeasy Phonecard but you will lose any remaining Credit and you will need to re-Credit your Speakeasy Phonecard. Within the Validity Period, the 120 or 365 days will re-start from the date of re-Credit. You can re-Credit your Speakeasy Phonecard using the following services.
  • 2.2 Top-up of existing card online at speakeasytelecom.com.
3. Call Rates:
  • 3.1 Please visit the Rates & Coverage page for Call Rates as published and updated from time to time. In the event of a conflict between any Call Rates set out on speakeasytelecom.com and any call rates set out on any other media, the Call Rates set out on speakeasytelecom.com shall take precedence.
  • 3.2 Each time you use Speakeasy Phonecard Services, the Credit on your Speakeasy Phonecard will be reduced by the charges incurred, calculated by Speakeasy applying and deducting the total of the Call Rates, and where applicable connection charges (as defined at paragraph 1.3b. above) and any surcharge apply (as defined at paragraph 3.3 below).
  • 3.3 All calls using the Speakeasy Phonecard Services are charged in one minute increments, rounded up to the nearest minute. In addition to the Connection Charge (where applicable) and the Call Rates (as respectively defined at paragraphs 1.3b. and 1.3c. above), some calls (for example, from a BT payphone) have an additional charge referred to as a "Surcharge"; for details of the surcharge, please see our FAQs.
  • 3.4 We will not charge you for calling our geographic access numbers (such as 0330 221 9932). However, you may incur charges from your phone service provider so please contact them to check whether this is the case and, if so, familiarise yourself with the charges which apply.
  • 3.5 Call Rates and connection charges (where applicable) and Surcharge are subject to change at any time.
  • 3.6 Every effort is made to ensure that Call Rates and connection charges (where applicable) and the surcharge is correct and up to date. Please visit the Rates & Coverage page for the most up to date Call Rates before you make a call as you will be charged at the then current rates listed at the time you make your call.
  • 3.7 All Call Rates, connection charges (where applicable) and the surcharge includes VAT.
4. No Refund:
  • 4.1 If your Speakeasy Phonecard or your landline telephone or any mobile phone through which you access the Services from time to time is lost, stolen, damaged or destroyed or otherwise rendered unusable (and you do not know the PIN) you will lose any remaining Credit to use the Speakeasy Phonecard Services. If the Speakeasy Phonecard Services are used in an unauthorised manner, we are not able to provide you with a refund of any Credit used in such manner.
  • 4.2 In addition, as stated in paragraph 2 (Validity Period) above, you will lose any remaining Credit to use the Speakeasy Phonecard Services after the Validity Period expires.
5. Restrictions:
  • 5.1 You cannot use the Speakeasy Phonecard Services for calling premium rate numbers or some non-geographic numbers (for example, 090).
  • 5.2 The Speakeasy Phonecard Services are intended by us to be used in the United Kingdom via landline or mobile, and from a selected number of countries abroad (see Talk Direct Travel Instruction guide for more information). If you access Speakeasy Phonecard Services from other jurisdictions, you do so at your own risk and potential additional cost, and you are responsible for your own compliance with local law.
6. Availability of Services:
  • 6.1 When we provide you with the Speakeasy Phonecard Services, we will use the reasonable skill and care of a competent service provider, but we cannot guarantee that the Speakeasy Phonecard Services will always be fault-free. Some things will be out of our control, for example, Speakeasy Phonecard Services are dependent on network operators and the services of such network operators can be affected by things that we cannot control.
  • 6.2 Your access to the Speakeasy Phonecard Services may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Your access may also be restricted if we are required to restrict it following instruction from the government, the emergency services or any other competent or lawful authority. In these circumstances, we will attempt to restore the service as soon as we reasonably can. If there is an unusual use of the Speakeasy Phonecard Services (for example, significantly increased traffic indicating fraudulent use), we may temporarily suspend your use of the Speakeasy Phonecard Services to prevent you from incurring excessive or unwanted charges.
7. Our Responsibility to You:
  • 7.1 Nothing in this paragraph 7 shall limit or affect our liability resulting from anything we provide to you being found to be unsafe or if something we do negligently causes death or personal injury.
  • 7.2 Subject to paragraph 7.1, if we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a directly foreseeable consequence to both of us at the time you buy the Speakeasy Phonecard Services. We do not assume any liability for content received from calls made by you using the Speakeasy Phonecard Services.
  • 7.3 You acknowledge that we are not responsible for providing (or maintaining) the equipment that you use to access the Speakeasy Phonecard Services or the national or international telecommunications networks which your calls travel across.
  • 7.6 Nothing in these Terms & Conditions affects your statutory rights (which include, for example, that we will provide the Speakeasy Phonecard Services to a reasonable standard and within a reasonable time). For more information on your statutory rights you can contact your local Citizens Advice Bureau or Trading Standards Office.
8. Your Responsibility to Us:
  • 8.1 You must not use the Speakeasy Phonecard Services for any unlawful or fraudulent purpose, to make any communication which is, or is intended to be, malicious, fraudulent or hoax (including to the emergency services) or in any way which may damage or affect the operation of the Speakeasy Phonecard Services or any other telecommunications system.
  • 8.2 If you do not comply with this paragraph 8, the Speakeasy Phonecard Services may be suspended indefinitely and you will compensate us for all liabilities, claims, damages, losses and costs (including legal costs) which we may suffer as a result.
9. Intellectual Property:
  • 9.1 The design of the Speakeasy Phonecard Services, and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to us. No licence is granted to you in these Terms and Conditions to use any trade mark of Speakeasy Telecom or its affiliated companies including, without limitation, the trade marks Call Me Baby, Love2Talk, Love2Talk GOLD, Speaksaver and Talk Direct.
10. Personal Information:
  • 10.1 If you provide personal information to us through using the Speakeasy Phonecard Services, we will not share it with anyone outside Speakeasy Telecom for marketing purposes.
  • 10.2 We will never disclose your information to anyone outside Speakeasy Telecom except where we have your consent; where we are required or permitted to do so by law; to other companies who provide a service to us; or any successors in title to our business.
  • 10.3 To obtain a copy of the information we hold about you, write to: Data Protection Officer, Speakeasy Telecom, Oakwood House, 422 Hackney Road London E2 7SY enclosing a cheque or postal order for £25 payable to "Speakeasy Telecom Limited". Please confirm your phonecard PIN and any other details to help us identify and locate your information. If any of the details are incorrect, let us know and we will amend them.
11. Marketing and Research:
  • 11.1 By using Speakeasy Phonecard Services, you agree that we may contact you with offers and information about our products and services. We may contact you with offers and information about our partners' products or services. Of course, the choice is entirely yours, but if you say you do not want to receive marketing information from us this will prevent you from receiving great offers or promotions that may be of interest to you.
12. General:
  • 12.1 If you allow another person to use your Speakeasy Phonecard Services they will be subject to these Terms & Conditions. We may transfer our rights under these Terms & Conditions to another business where we reasonably believe your rights will not be affected.
  • 12.2 By using the Speakeasy Phonecard Services, you represent to us that you are fully able and competent to enter into and abide by these Terms & Conditions.
  • 12.3 If you breach these Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms & Conditions.
  • 12.4 We shall not be responsible for any breach of these Terms & Conditions caused by circumstances beyond our reasonable control.
  • 12.5 These Terms & Conditions are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.
  • 12.6 These Terms & Conditions shall constitute the entire agreement between you and us regarding use of the Speakeasy Phonecard Services. If any provision of these Terms & Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms & Conditions, which shall remain in full force and effect.
  • 12.7 We may modify these Terms & Conditions at any time without notice to you and it is your responsibility to review these Terms & Conditions for any changes. Your continued use of the Speakeasy Phonecard Services following any amendment of these Terms & Conditions will signify your assent to and acceptance of its revised terms.
  • 12.8 Except as stated otherwise in this paragraph 12.8, a person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act. Any member of Speakeasy Telecom may enforce any provision of these terms as if it were a party to these terms.

14. Complete Agreement:
  • These provisions constitute the entire Agreement between you and Speakeasy Telecom with respect to the use of this site and any Software, Content, or Product contained therein, unless specified and marked "Addendum" on the site.
